1. Agreement to Terms

Welcome to B3 - Bean, Brew and Beyond. By accessing or using our mobile application, website, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and B3 - Bean, Brew and Beyond ("B3," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Services after any changes indicates your acceptance of the modified Terms.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 13 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement. Users under 18 must have permission from a parent or guardian to use the Services.

2.2 Account Creation

To place orders, you must create an account by providing:

  • Accurate and complete personal information
  • A valid email address and phone number
  • A secure password

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3 Account Suspension

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You provide false or misleading information
  • You engage in fraudulent or illegal activities
  • You abuse our loyalty program or promotional offers
  • Your account remains inactive for an extended period

3. Orders and Payments

3.1 Placing Orders

When you place an order through our Services, you agree to:

  • Provide accurate order details and delivery information
  • Pay the total amount displayed at checkout
  • Accept that all orders are subject to availability
  • Acknowledge that menu items, prices, and availability may change without notice

3.2 Payment Processing

All payments are processed securely through Razorpay, our third-party payment gateway. By making a payment, you agree to Razorpay's terms and conditions. We accept:

  • Credit and debit cards (Visa, MasterCard, American Express, RuPay)
  • UPI (Unified Payments Interface)
  • Net banking
  • Digital wallets (Paytm, PhonePe, Google Pay, etc.)

Payment must be completed at the time of order placement. We do not store your payment card details. All payment information is handled directly by Razorpay in compliance with PCI-DSS standards.

3.3 Pricing and Taxes

  • All prices are listed in Indian Rupees (INR)
  • Prices include applicable taxes unless otherwise stated
  • We reserve the right to modify prices at any time without prior notice
  • Price errors: If an item is incorrectly priced, we may cancel the order and refund you
  • Additional charges may apply for delivery (when available)

3.4 Order Confirmation

Once your payment is processed successfully, you will receive an order confirmation via email and/or SMS. This confirmation indicates that your order has been received and payment has been verified. However, it does not guarantee that all items will be available or that the order will be fulfilled exactly as requested.

3.5 Order Modifications

Once an order is placed and payment is confirmed, modifications may not be possible. If you need to modify or cancel your order, please contact us immediately at the outlet or through customer support. We will do our best to accommodate your request, but we cannot guarantee that changes will be possible.

4. Loyalty Program and Rewards

4.1 Earning Points

Our loyalty program allows you to earn reward points on eligible purchases:

  • Points are earned on completed and paid orders
  • Points are calculated based on the subtotal before discounts
  • Promotional items or discounted items may earn reduced points or no points
  • Points are credited to your account after order completion

4.2 Redeeming Points

  • Points can be redeemed for discounts on future orders
  • Maximum discount: 50% of order value
  • Points must be redeemed at the time of checkout
  • Points cannot be transferred, sold, or exchanged for cash
  • Points have no cash value

4.3 Points Expiration

Reward points may expire if not used within a specified period (as communicated via the app). We will notify you before points expire. Expired points cannot be reinstated.

4.4 Program Modifications

We reserve the right to modify, suspend, or terminate the loyalty program at any time with reasonable notice. Changes to the program may include earning rates, redemption values, expiration policies, and eligibility criteria.

4.5 Abuse Prevention

Any fraudulent activity, abuse, or gaming of the loyalty program may result in:

  • Forfeiture of all accumulated points
  • Account suspension or termination
  • Legal action if fraud is detected

5. Delivery and Pickup

5.1 Service Types

We offer the following service types:

  • Dine-In: Order in advance and dine at our outlets
  • Takeaway/Pickup: Order online and pick up at the selected outlet
  • Delivery: (When available) Home delivery service

5.2 Preparation Times

Estimated preparation and delivery times are approximate and may vary based on outlet capacity, time of day, and other factors. We strive to fulfill orders as quickly as possible but cannot guarantee specific timeframes.

5.3 Order Pickup

  • You must present your order confirmation (order ID) when picking up
  • Orders not picked up within 2 hours may be cancelled without refund
  • Cold beverages and perishable items have shorter pickup windows

5.4 Delivery Service (When Available)

For delivery orders:

  • Delivery is subject to location and availability
  • Delivery fees may apply and are shown at checkout
  • You must provide accurate delivery address and contact information
  • Someone must be available to receive the order
  • We are not responsible for incorrect addresses or unreachable customers

6. Refunds and Cancellations

For detailed information about refunds and cancellations, please refer to our Refund and Cancellation Policy.

Key points:

  • Cancellations may be possible before order preparation begins
  • Refunds are processed to the original payment method
  • Quality issues must be reported within a reasonable timeframe
  • Refund processing may take 5-7 business days

7. User Conduct and Responsibilities

You agree NOT to:

  • Use the Services for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe upon the rights of others
  • Upload viruses, malware, or any malicious code
  • Attempt to gain unauthorized access to our systems
  • Scrape, crawl, or harvest data from the Services
  • Impersonate any person or entity
  • Harass, abuse, or harm other users or our staff
  • Submit false or fraudulent orders
  • Abuse promotional offers or loyalty programs
  • Reverse engineer or decompile any part of the Services

8. Intellectual Property

8.1 Our Content

All content on our Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of B3 or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. This license does not include any right to:

  • Modify or copy the materials
  • Use the materials for commercial purposes
  • Remove any copyright or proprietary notations
  • Transfer the materials to another person

8.3 Trademarks

"B3," "Bean, Brew and Beyond," and all related logos and product names are trademarks of B3. You may not use these trademarks without our prior written permission.

9. Disclaimers and Limitation of Liability

9.1 Service "As Is"

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee of Availability

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Services at any time without notice.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, B3 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or ₹1,000, whichever is greater.

9.4 Food Allergies and Dietary Restrictions

While we make every effort to accommodate dietary restrictions and allergies, we cannot guarantee that our products are free from allergens. Cross-contamination may occur. If you have severe allergies, please consult with our staff before ordering.

10. Indemnification

You agree to indemnify, defend, and hold harmless B3 and its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your use or misuse of the Services
  • Your breach of any representation or warranty

11. Dispute Resolution

11.1 Informal Resolution

If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally by contacting our customer support at support@beanbrewbeyond.com.

11.2 Arbitration

If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

11.3 Class Action Waiver

You agree to bring claims against us only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Gurgaon, India, for the resolution of any disputes.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and disclose your personal information. By using the Services, you consent to our collection and use of personal information as outlined in the Privacy Policy.

14. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination:

  • Your right to use the Services will immediately cease
  • You will no longer be able to access your account
  • Unused reward points may be forfeited
  • Outstanding orders will be processed according to our refund policy

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Updating the "Last Updated" date at the top of this page
  • Sending an email notification to your registered email address
  • Displaying an in-app notification

Your continued use of the Services after any changes indicates your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and B3 regarding the use of the Services and supersede all prior agreements and understandings, whether written or oral.

19. Acknowledgment

BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTOOD THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THE SERVICES.

These Terms of Service are effective as of January 24, 2025 and will remain in effect except with respect to any changes in their provisions in the future, which will be in effect immediately after being posted on this page.
